1. Introduction

This policy tells you what information we collect from you, what we do with it, who can access it, and what you can do about it. It covers all the products and services provided through www.jensii.ca and jenisys.cloud, and by Jensii Marketing Ltd.

Our privacy commitment:

Jensii does not sell your information to advertisers or show you other people's ads. This has been our approach for more than 25 years, and we remain committed to it.

2. Privacy for Our Website Visitors

2.1 Information Collection

We do not use cookies. When you visit our website, we do not collect personal information and we do not track you.

We use privacy-focused video delivery through Bunny.net, which:

  • Collects partially anonymized IP addresses (last octet removed)
  • Stores basic device information for playback optimization
  • Maintains video analytics for 30 days
  • Processes data at global edge locations
  • Maintains ISO 27001 compliance and processes data in accordance with GDPR requirements

If you use a contact form on our website, we may collect:

  • Your name
  • Business name
  • Position at your business
  • Email address
  • Telephone number
  • Any other information you provide in the message

If you sign up for one of our newsletters, we may collect:

  • Your Name
  • Business Name
  • Email address

Personal information is only collected for purposes that a reasonable person would consider appropriate in the circumstances.

By submitting your personal information through our website(s), you explicity give consent for us to contact you by email, phone, text, or mail.

2.2 Use of Information

For website visitors, we use your information to:

2.3 Data Sharing & Storage

We may share your personal information on a need-to-know basis with our employees, contractors, and service providers. Service providers are companies that provide digital services and software as a service. For example, we use a service provider to send our newsletters via email.

Our Service providers are often located outside of Alberta and Canada, usually in the EU, USA, or Great Britain.

2.4 Data Retention

Information submitted through contact forms is retained as long as necessary to respond to your inquiry and for any follow-up communications.

Information obtained through newsletter signups is retained until you unsubscribe from the newsletter.

2.5 Information from social media sites and other publicly available sources

When you provide feedback or reviews about our products, interact, or engage with us on marketplaces, review sites or social media sites such as Facebook, Twitter, LinkedIn and Instagram through posts, comments, questions and other interactions, we may collect such publicly available information, including profile information, to allow us to connect with you, improve our products, better understand user reactions and issues or to reproduce and publish your feedback on our websites. We must tell you that once collected, this information may remain with us even if you delete it from these sites. Jensii may also add and update information about you from other publicly available sources.

2.6 Retention of information

We retain your personal information for as long as it is required for the purposes stated in this Privacy Policy. Sometimes, we may retain your information for longer periods as permitted or required by law, such as to maintain suppression lists, prevent abuse, if required in connection with a legal claim or proceeding, to enforce our agreements, for tax, accounting, or to comply with other legal obligations. When we no longer have a legitimate need to process your information, we will delete or anonymize your information from our active databases.

2.7 Your Rights with Respect to Personal Information

Jensii is committed to ensuring you retain full access to and control of your personal information. To that end, we endeavour to respect your right to be informed regarding the collection, use and disclosure of personal information, and your right of correction and access to it, via this Privacy Statement.

You have the right to:

  • Access and correct your personal information
  • Request deletion or transfer of your data
  • Object to or restrict certain processing

If you would like to access, correct, remove, request a copy of, withdraw consent to the collection of your personal information, or are looking for any additional information on how your personal information may be collected, used or disclosed by Jensii, please contact the Jensii Privacy Officer at admin@jensii.ca. Subject to certain exceptions and limitations that may be prescribed by applicable law, you will be provided with reasonable access to your personal information and will be entitled to have it amended or corrected as appropriate.

To exercise these rights or for any privacy-related inquiries, contact our Privacy Officer at admin@jensii.ca. Jensii might assess charges for this service.

We will disclose personal information if it's necessary to comply with a legal obligation, prevent fraud, enforce an agreement, or protect our customers' or website visitors' safety.

2.8 Data Breach Notification

In the event of a privacy breach that creates a real risk of significant harm to individuals, we are committed to the following actions:

  1. We will notify affected individuals as soon as reasonably possible, providing details about the breach and steps they can take to protect themselves.
  2. We will report the breach to the Office of the Information and Privacy Commissioner of Alberta without unreasonable delay, including details of the breach and our response.
  3. Our notification will include:
    • A description of the circumstances of the breach
    • The date or time period of the breach
    • A description of the personal information involved
    • Steps taken to reduce the risk of harm
    • Steps individuals can take to further mitigate the risk of harm
    • Contact information for our privacy officer
  4. We will conduct a thorough investigation of the breach and take necessary steps to prevent future occurrences.

Our data breach notification process applies to personal information as defined by Alberta's Personal Information Protection Act.

3. Privacy for our Customers

If we provide marketing, public relations, website, advertising, or communications services, we often acquire an intimate understanding of the objectives, challenges, competition, and market demands of your business/organization.

3.1 Collecting Information

Jensii will collect extensive business information from you to provide access to services we offer.

We may capture, store, and analyze all communications with you. This includes email, text (SMS), chat, and telephone conversations, surveys, data collection forms, and recorded meetings, which may be stored in summarized form.

3.2 What we do with your information

We analyze the information we collect to understand your needs, plan and manage your services, orient people working on your project, and improve our services and websites.

We use the information you provide us for the following purposes:

  • Determine your eligibility for our services
  • Provide you with our services
  • Prevent unauthorized activity on your accounts
  • Assist in ongoing support relating to our services

By using our services you explicitly consent to us contacting you by email, phone, text, mail, or through your account. You may opt out of receiving communications that are not essential to the provision of our services.

3.3 Sharing Your Data

Jensii shares your information with its employees, contractors, and service providers. Service providers are companies that provide digital services, and software as a service.

Suppose you handle other people's data using Jensii websites or apps, such as information about your customers or employees. In that case, you are entrusting that data to us for processing. Suppose you deploy a Jensii mobile app and your visitors give the app access to their location and photo library. In that case, they are entrusting data to you, and subsequently to us. The data you entrust to us for processing is called "service data".

You own your service data. We protect it, limit access to it, and only process it as required to provide service to you. You may access it, share it through third-party integrations, and request that we export or delete it.

We may share your information, service data, and aggregated information with service providers that we engage. If we engage service providers, they must have commercially adequate security measures, clear privacy policies, and a valid reason for using your information, typically to serve you.

Our service providers are often located outside of Canada, usually in the EU, USA, or Great Britain.

3.4 Content Delivery Network

Jensii uses a Content Delivery Network (CDN) for your websites and web apps but does not provide personal data to the CDN.

Information entered by visitors to your website is routed directly to Jensii servers and is not processed by the CDN. This information is authenticated at Jensii servers and emailed to your designated email address. Jensii does not retain it unless it is required for some other service we provide to you.

3.5 Third-party integrations you have approved

Most of our products and services support integrations with third-party products and services, such as Google Maps. Suppose you choose to enable any third-party integrations. In that case, you may be allowing a third party to access your service data and personal information about you. We encourage you to review the privacy practices of the third-party services and products before you approve us to enable integrations with them.

3.6 Data Retention

Jensii maintains your information while it is legally required and for the ongoing service we provide.

We hold the data in your account while you use Jensii Services. After you terminate your account, your data will be automatically anonymized or deleted from our active database within 6 months and from our backups within 6 months after that.

3.7 Data Breach Notification

Our data breach notification process primarily applies to personal information as defined by Alberta's Personal Information Protection Act. This includes information about identifiable individuals, which may sometimes include business contact information.

For breaches involving our business customers' data that do not qualify as personal information under PIPA, we will follow notification procedures as outlined in our service agreements or based on our assessment of the breach's potential impact on our customers' operations.

Processing of Service Data

Service data may include personal information about our customers' clients, members, or users.

In the event of a breach affecting this data:

  1. We will promptly notify the affected business customer(s) and provide all relevant information about the breach.
  2. We will cooperate fully with our customer(s) to investigate and resolve the breach.
  3. Notifying affected individuals and the Privacy Commissioner is our customer's responsibility as the data controller. However, we will provide all necessary support and information to facilitate this process.
  4. If our agreement with a customer requires us to make direct notifications, we will do so in coordination with the customer.

We maintain strict security measures to protect all data we process, including service data provided by our customers.

4. Employee Privacy Practices

We collect, use, and disclose employee personal information in accordance with PIPA and PEPIDA. Key points include:

  1. Employee personal information is never moved outside of Canada.
  2. We collect and use employee personal information necessary to establish, manage, or terminate the employment relationship.
  3. Consent is not required for collection, use, or disclosure of employee personal information if it's reasonable to establish, manage, or terminate the employment relationship.
  4. We will obtain consent for any collection, use, or disclosure of employee personal information beyond what's reasonable for employment purposes.
  5. Employees have the right to access their personal information and request corrections.
  6. We protect the confidentiality of employee personal information and limit access to those who need it for legitimate business purposes.

5. General Privacy Practices

5.1 Children's Personal Information

Jensii does not knowingly collect personal information from children under 16 years of age. If we become aware that a child under 16 has provided us with personal information, we will take steps to delete such information. If you believe that a child under 16 years has provided personal information to us, please write to admin@jensii.ca with the details, and we will take the necessary steps to delete the information we hold about that child.

However, using our products, you can collect information about individuals who may be children. If you process information relating to children, you acknowledge and agree that you will be responsible for complying with the applicable laws and regulations related to the protection of such personal information.

5.2 Automation and Artificial Intelligence

To provide enhanced productivity and predictive capabilities to our users, we employ various technologies such as artificial intelligence and machine learning. We make limited use of your information for these technologies. Our automation and artificial intelligence technologies are mostly powered by our own organization's data, such as internal communications, communications with customers, internal documents, as well as external sources.

5.3 Disclosures in compliance with legal obligations

We may be required by law to preserve or disclose your personal information and service data to comply with any applicable law, regulation, legal process or governmental request, including to meet national security requirements.

5.4 Enforcement of our rights

We may disclose personal information and service data to a third party if we believe that such disclosure is necessary for preventing fraud, spam filtering, investigating any suspected illegal activity, enforcing our agreements or policies, or protecting the safety of our users.

5.5 Business Transfers

We do not intend to sell our business. However, in the unlikely event that we sell our business or get acquired or merged, we will ensure that the acquiring entity is legally bound to honour our commitments to you. We will notify you via email or through a prominent notice on our website of any change in ownership or in the uses of your personal information and service data. We will also notify you about any choices you may have regarding your personal information and service data.

5.6 Compliance with this Privacy Policy

We make every effort to ensure that personal information you provide is used in conformity with this Privacy Policy. We provide comprehensive, proactive server security to keep your data safe and secure and out of the hands of hackers.

5.8 External Links and Third-Party Websites

Our website may contain links to external sites or services that are not owned or controlled by Jensii. Jensii has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the privacy policy and terms and conditions of any third-party website that you visit.

  1. No Endorsement: The presence of any links to external websites does not imply a recommendation or endorsement of the views expressed within them.
  2. At Your Own Risk: Clicking on external links or third-party advertisements will take you to websites outside of our control. You access these websites at your own risk.
  3. Different Privacy Practices: Please note that these other websites may collect personal information about you and may use and share such information in ways that differ from our practices. We encourage you to carefully review the privacy policies of any website you visit.
  4. No Liability: Jensii will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any linked third-party websites or services.
  5. Security: While we strive to only link to reputable websites, we cannot guarantee the security or reliability of any linked websites. Always exercise caution and use your best judgment when submitting personal information on any website.
  6. Updates to External Sites: The content and privacy practices of linked websites may change over time. While we try to keep our links current, we are not responsible for outdated or changed content on linked sites.
  7. Leaving Our Site: In some cases, you may be notified when leaving our site via an external link. However, the absence of such notification does not imply any responsibility on our part for the destination site.

By accepting this Privacy Policy, you explicitly consent to the following process for future updates:

We may modify this Privacy Policy from time to time. When we do, we will notify you via email and/or prominent notice on our website.

Your continued use of our services after the effective date of changes to the Privacy Policy will be deemed to be your agreement to the modified Privacy Policy.

For significant changes to how we collect, use, or disclose your personal information, we will seek your explicit consent again. You will be provided with at least 30 days advance notice of the changes by email to your primary email address. However, if you have not verified your email address, you may miss important notifications that we send through email.
